1. Definitions

• "Service" refers to the business consulting arrangements offered by Damai Pakar, including the Listening Session, Team Harmony Review, and Steady Companionship.
• "User" or "Client" refers to any individual or business owner who engages with our website or enters into a consulting arrangement with us.
• "We", "Us", "Our" refers to Damai Pakar, operating from 9, Jalan Dato Onn, 70000 Seremban, Negeri Sembilan, Malaysia.
• "Agreement" refers to these Terms & Conditions together with any written engagement letter or confirmation provided before services begin.

2. Acceptance of Terms

By using our website or entering into a consulting engagement with Damai Pakar, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement in Malaysia. If you are entering into an engagement on behalf of a business, you confirm that you have authority to bind that business to these terms.

3. Service Description

Damai Pakar provides business consulting services for small business owners. Our current service offerings are:

• Listening Session — a single consulting session with a written recap note. Price: RM 340.
• Team Harmony Review — two sessions across five weeks with a written summary report. Price: RM 820.
• Steady Companionship — monthly meetings over twelve months with quarterly summaries and between-session email support. Price: RM 1,530 per year.

Services are available in Seremban and surrounding areas in person, and remotely via video call for clients elsewhere in Malaysia.

4. Client Responsibilities

As a client of Damai Pakar, you agree to:

• Provide accurate and honest information relevant to your engagement
• Attend scheduled sessions at the agreed time, or give reasonable notice (at least 48 hours) if you need to reschedule
• Use the written summaries and materials we provide for your own business purposes only
• Not reproduce, share, or distribute our session materials without prior written agreement
• Treat our consultants with courtesy and professionalism throughout the engagement

5. Payment Terms

All prices are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated. Payment terms are as follows:

• Listening Session and Team Harmony Review: full payment is required before the first session begins
• Steady Companionship: payment may be made annually upfront or by arrangement. We will confirm terms in writing before the engagement starts.
• Accepted payment methods: bank transfer (Maybank or CIMB), e-wallet (TNG, Boost), or cash at our office

Invoices will be issued upon confirmation of engagement. Receipts will be provided on request.

6. Cancellation and Refund Policy

We understand that circumstances change. Our cancellation terms are:

• Cancellation with more than 5 business days' notice: full refund
• Cancellation with 2–5 business days' notice: 50% refund
• Cancellation with less than 2 business days' notice: no refund (session fee is forfeited)
• For Steady Companionship: unused months beyond the first three may be refunded on a pro-rata basis if the engagement is terminated by the client with written notice

We reserve the right to reschedule a session at no penalty if circumstances on our end require it. We will give at least 48 hours' notice where possible.

7. Confidentiality

We treat all information shared during consulting sessions as strictly confidential. We will not disclose your business details, personal situation, or the content of our sessions to any third party without your written consent, except where required by Malaysian law. This obligation survives the end of the engagement.

8. Intellectual Property

All written materials produced by Damai Pakar — including session notes, summaries, and reports — are provided to you for your personal and business use. You may not:

• Reproduce or distribute our materials commercially without written permission
• Use our name, logo, or materials in any way that implies endorsement
• Present our written work as your own in any published context

The content on our website, including text, structure, and design, is the property of Damai Pakar. Unauthorised reproduction is not permitted.

9. Disclaimer

Damai Pakar provides consulting support to help you reflect on your business situation and consider options. We do not:

• Provide legal, financial, tax, or accounting advice
• Make binding recommendations or decisions on your behalf
• Accept responsibility for business outcomes that arise from decisions you make following our sessions

Our role is to assist your thinking, not to substitute for professional legal or financial advice where that is required.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Damai Pakar's liability for any claim arising from our services shall not exceed the total fees paid by you for the specific engagement to which the claim relates. We are not liable for indirect, consequential, or incidental losses arising from the use of our services or website.

11. Termination

Either party may terminate an ongoing engagement by providing written notice. In such cases, payment obligations for sessions already completed remain in force. Refund terms for pre-paid amounts are governed by Section 6 above.

12. Governing Law and Dispute Resolution

These Terms & Conditions are governed by the laws of Malaysia. Any dispute arising shall be subject to the jurisdiction of the courts of Negeri Sembilan, Malaysia.

13. Changes to These Terms

We may update these Terms & Conditions from time to time. Significant changes will be reflected in the "Last Updated" date above. Continued use of our services or website after any changes constitutes your acceptance of the revised terms.
